Scope and how the Services work

This Privacy Policy applies to your use of the Services but does not apply to any website, offering, product, or service of any third party, even if that third party's website links to our Services. We do not control third-party websites, offerings, products, or services, so please review their privacy policies before providing any information. If you do not consent to the terms of this Privacy Policy, please do not use, or discontinue your use of, the Services.

Website and Web Application. As part of the Services, you may access and log into the Web Application, which allows you to access certain features including booking and vacation guides made available from time to time. You may also share ideas, feedback, and other content through your use of the Services. The Website allows users to learn more about the Company and view the various services we offer.

How the Services work. Our Services provide vacation-planning information along with access to our reservation systems and third-party reservation engines made available via the Web Application.

Key definitions

Personal Information means information that allows someone to identify or contact you — for example, your name, address, telephone number, email address, and any other non-public information associated with the foregoing.

Anonymous Information means information that is not associated with or linked to your Personal Information and does not enable identification of, or contact with, an individual.

Children

We do not knowingly collect or maintain Personal Information from anyone under 13 years of age. If you are under 13, please do not use the Services.

A note to users outside the United States

Company is based in the U.S. If you are a non-U.S. user of the Services, by visiting the Website or using the Web Application you acknowledge that your Personal Information may be processed in the United States and other countries, where data protection laws may differ from those in your country. By providing your information and agreeing to this Privacy Policy, you consent to such transfer.

Information we collect

Personal Information

We collect Personal Information to provide the Services to you and to help us understand how the Services are used, including:

• Voluntary information. Information you provide directly to us so that we can provide the Services, including information you share when you contact us by email for support.
• Bookings made online. When you make an online booking with us, your information is transmitted securely into our property management software, which stores it on our behalf to facilitate your reservation.
• Account and usage information. If you create an account, we may collect your name, mailing or billing address, email address, phone number, and location information where applicable.
• Third-party and analytics sources. We may obtain information about you from third parties or through our indexing and analytics tools.
• Communications. When you email or otherwise communicate with us, we collect and store the information contained in those communications.
• Social media interactions. If our Services allow you to connect or interact with social media platforms such as Facebook or Instagram, any information we receive depends on the privacy settings you have with that platform. Please review that platform's privacy policy for details on its data practices.
• Location information. If you have enabled location services on your device, we may collect your location to provide location-relevant features. You can disable location services at any time through your device settings.
• Email subscriptions. If you subscribe to our email list to receive news, area information, specials, and promotions, you agree that we may use your contact information for marketing purposes. All marketing emails will identify Colonial Properties as the sender, include our physical mailing address, and provide a working unsubscribe mechanism, consistent with the CAN-SPAM Act. You may unsubscribe at any time using the link in the footer of our marketing emails.
• Text and SMS messages. If you opt in to receive text messages from us, message and data rates may apply, and message frequency may vary. You may opt out at any time by replying STOP, and can reply HELP for assistance. We will only send text messages to numbers that have provided express consent, consistent with the Telephone Consumer Protection Act (TCPA).
• Other. We may collect additional Personal Information at other points in our Services where we state that Personal Information is being collected.

Anonymous Information

We also collect Anonymous Information, including:

• Server and log information. Our servers, which may be hosted by a third-party provider, automatically collect information such as browser type, operating system, IP address, domain name, and date and time stamps for your visit. We use this to analyze trends, administer the Website, and improve the user experience.

• Pixel tags. We may use pixel tags, also called clear GIFs or web beacons, to help us understand how users interact with our emails and Website, and to determine whether emails have been opened.

How we use information

Personal Information. We use your Personal Information to:

• Provide and administer our online booking system
• Create and manage your account, where applicable
• Provide the Services and complete your transactions
• Provide customer support and respond to your requests
• Understand your needs and tailor our content and offerings
• Resolve disputes and troubleshoot problems

• Send newsletters, offers, and other marketing communications
• Improve the quality and functionality of our Services
• Communicate with you generally about the Services

We may also use Personal Information to create Anonymous Information by removing information that would otherwise make it personally identifiable.

Anonymous Information. We use Anonymous Information to analyze trends, administer and improve the Services, understand our user base, and tailor our offerings. We reserve the right to use and disclose Anonymous Information for any purpose, including sharing aggregated or anonymized insights with partners, advertisers, and other third parties.

How we disclose information

• Property management and booking partners. We share the information you provide when making a reservation with the third-party providers of our property management and booking software, so they can facilitate your current and future bookings.
• Service providers. We may share Personal Information with third-party service providers who perform services on our behalf, such as data analytics, website hosting, payment processing, IT support, customer service, and email delivery.
• Advertising and analytics partners. As described above, we work with advertising and analytics partners who may receive information such as cookie identifiers and browsing behavior. Under California and certain other state privacy laws, this activity may be considered "sharing" or a form of "sale," even though we do not exchange Personal Information for money. • Corporate transactions. We may disclose Personal Information in connection with a merger, acquisition, financing, reorganization, or sale of some or all of our business or assets. If another company acquires our business, that company will assume the rights and obligations described in this Privacy Policy.
• Legal requirements. We do not sell Personal Information for monetary consideration.

Your choices regarding your information

• Email communications. You can opt out of marketing emails at any time using the "Unsubscribe" link in the footer of those emails. Even after opting out, we may still send you non-marketing, Services-related communications such as booking confirmations.
• Text and SMS communications. You can opt out of text messages at any time by replying STOP.
• Cookies. You can manage your cookie preferences at any time using the "Your Privacy Choices" link in our website footer, or by instructing your browser to refuse cookies or notify you when a cookie is being set. Please note that some parts of the Services may not function properly without cookies.
• Global Privacy Control (GPC). We recognize and honor the Global Privacy Control browser signal as a valid request to opt out of the sale or sharing of Personal Information for California residents and residents of other states that recognize GPC as an opt-out mechanism.
• Accessing, updating, or deleting your information. You may request to review, update, correct, or delete your Personal Information by contacting us using the information below. We will make commercially reasonable efforts to honor your request, though we may need to retain certain information as required by law or for legitimate business purposes, for example completed reservation records.
• Location data. You may disable location services for our Services at any time through your device settings.

Your privacy rights

California residents

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), may give you the following rights with respect to your personal information:

• Right to know — the categories and specific pieces of personal information we have collected about you, and the sources, purposes, and third parties involved.
• Right to delete — request deletion of personal information we have collected from you, subject to certain legal exceptions.
• Right to correct — request correction of inaccurate personal information we maintain about you.
• Right to opt out of sale or sharing — as described above, you can opt out at any time using the "Your Privacy Choices" link in our footer or an enabled GPC signal.
• Right to limit use of sensitive personal information — where applicable.
• Right to non-discrimination — we will not deny goods or services, charge different prices, or provide a different level of service because you exercised any of these rights.

This section supplements, and does not replace, our disclosures under California Civil Code § 1798.83, under which California residents may separately request information regarding disclosure of personal information to third parties for their own direct marketing purposes.

Residents of other states

If you are a resident of Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, or another state with a comprehensive consumer privacy law, you may have similar rights to those described above, including rights to access, correct, delete, and obtain a portable copy of your personal information, and to opt out of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. Third-party links

The Services may contain links to third-party websites that we do not own or control. We are not responsible for the privacy practices or content of those websites. We encourage you to review the privacy policy of any third-party site you visit.

Video content

Our Website may include video content, such as promotional or property tour videos. Some jurisdictions, including under the U.S. Video Privacy Protection Act ("VPPA"), regulate the disclosure of information about the video content you request or view. We do not knowingly disclose information that would personally identify you as having requested or viewed specific video content to third parties without your consent, except as required or permitted by law, or where such disclosure is anonymized or aggregated such that it does not identify you as an individual. Do Not Track

Most web browsers offer a "Do Not Track" signal. Because there is no common industry standard for how to interpret it, we do not currently respond to it. We do, however, honor the Global Privacy Control (GPC) signal as described above.

International users

If data protection law in your jurisdiction distinguishes between a data "controller" and "processor," you are generally the controller of the data and information you submit through the Services, and Company generally acts as the processor of that data.

Users in certain jurisdictions, including the European Economic Area, may have additional statutory rights with respect to their personal data, including rights to access, correct, or delete that information, and to object to our use of their Personal Information for direct marketing purposes. Data retention and security

Although most changes are likely to be minor, Colonial Properties may change its Privacy Policy from time to time at Colonial Properties' sole discretion. Colonial Properties encourages visitors to frequently check this page for any changes to its Privacy Policy.
